We'll move on to item 2, therefore, and provide the usual preamble. Should there be a fire alarm, Members should leave the room through the designated fire exits and follow instructions from the ushers. Naturally, the Senedd operates through the media of Welsh and English, and headphones are available for interpretation and they can also be used for amplification for those who are hard of hearing. Interpretation is available on channel 1 and the floor language on channel 2.

We will move on, therefore, to item 3: instruments that raise issues to be reported to the Assembly under Standing Order 21.2 or 21.3. First of all, affirmative resolution instruments. Item 3.1: SL(5)482, the Representation of the People (Annual Canvass) (Amendment) (Wales) Regulations 2020. You have papers 1, 2, 3 and 4, and paper 4 is a letter from the Minister for Housing and Local Government—you will have seen those. Now, these regulations provide for the reformed annual canvass to apply to a register of local government electors in Wales. These regulations are part of a package of statutory instruments that will ensure that the same changes to the annual canvass are introduced across Great Britain. The letter from the Minister explains the timing of the regulations. Are there any comments from the lawyers?

Yes, there is one merits point on page of 1 of the pack, which welcomes clarity on the explanatory memorandum. It's also noted that these regulations are dependent on the Government of Wales Act 2006 amendment Order. At the time of setting down these regulations that Order was not in force, but now that Order is in force.

Nawr, mae Deddf Safonau a Threfniadaeth Ysgolion (Cymru) 2013 yn ei gwneud yn ofynnol i awdurdod lleol lunio cynllun strategol Cymraeg mewn addysg, ac mae'n rhaid ei gyflwyno i'w gymeradwyo gan Weinidogion Cymru. Moving on to negative resolution instruments. Item 3.2: SL(5)478, the Welsh in Education Strategic Plans (Wales) Regulations 2019. In your pack, you have papers 5, 6 and 7, and paper 7 is the explanatory memorandum.

Now, the School Standards and Organisation (Wales) Act 2013 requires a local authority to prepare a Welsh in education strategic plan, which must be submitted for approval from Welsh Ministers. These regulations make provision for a local authority to prepare a 10-year plan, the first to have effect from 1 September 2021.

Assembly lawyers have identified technical and merits points for reporting, and the Government's response has been received.

Mae un pwynt technegol ar dudalen 48 o'r pecyn, sy'n nodi bod un diffiniad wedi'i gynnwys mewn troednodyn a'i bod hi'n well cynnwys diffiniadau yn y rheoliadau eu hunain yn hytrach nag mewn troednodyn.

There is one technical point on pack-page 48, which notes that one definition is in a footnote, and that it's better to include definitions in regulations rather than in a footnote.

In terms of a merits point, on pack-page 49 it notes that the explanatory memorandum says that these regulations are subject to the Assembly's views, and we ask what these views are, given that these are not affirmative resolution regulations and there will not be a full debate to approve the regulations. The Government has responded by saying that the wording 'is subject to the Assembly's views' has been included by mistake and that the explanatory memorandum will be rectified.

Just a question on the first point: has the Government made any reference to that?

It's a minor issue, of course, but there we go—it would provide some comfort to us.

Nawr, mae Rheoliadau Rhentu Cartrefi (Ffioedd etc.) (Blaendal Cadw) (Gwybodaeth Benodedig) (Cymru) 2019 yn nodi gwybodaeth y mae'n rhaid i'r landlord neu'r asiant gosod eiddo ei rhoi i ddarpar ddeiliad contract cyn y telir blaendal cadw. Mae'r rheoliadau hyn hefyd yn pennu'r ffordd y mae'n rhaid rhoi'r wybodaeth.

Gwnaethom ystyried Rheoliadau Rhentu Cartrefi (Ffioedd etc.) (Gwybodaeth Benodedig) (Cymru) 2019, fel dŷch chi'n cofio, ar 2 Rhagfyr 2019, a nodi llythyr gan y Gymdeithas Landlordiaid Preswyl, a oedd wedi mynegi pryderon ynghylch y rheoliadau hynny. Mae'r llythyr dyddiedig 6 Rhagfyr gan y Gweinidog yn nodi bod y Llywodraeth wedi ymdrin â'r pryderon gan y landlordiaid, asiantau a chyrff cynrychioladol yn Rheoliadau Rhentu Cartrefi (Ffioedd etc.) (Blaendal Cadw) (Gwybodaeth Benodedig) (Cymru) 2019.

Mae cyfreithwyr y Cynulliad wedi nodi un pwynt rhinweddau i gyflwyno adroddiad arno, sy'n nodi y gwnaed y rheoliadau yn groes i'r rheol 21 diwrnod—y cyfreithiwr i ymhelaethu. 

Okay, with that additional explanation from Government, is everyone content to pass these? Yes.

We move on—thank you very much—to item 3.3: SL(5)481, the Renting Homes (Fees etc.) (Holding Deposit) (Specified Information) (Wales) Regulations 2019. You have papers 8, 9, 10 and 11. Paper 10 is the explanatory memorandum and paper 11 is a letter from the Minister for Finance and Trefnydd to the Llywydd, dated 6 December.

Now, the Renting Homes (Fees etc.) (Holding Deposit) (Specified Information) (Wales) Regulations 2019 set out the information that must be provided to a prospective contract holder by either the landlord or the letting agent before the holding deposit is paid. These regulations also specify the way in which this information must be provided.

We considered the Renting Homes (Fees etc.) (Specified Information) (Wales) Regulations 2019 on 2 December 2019, and noted a letter from the Residential Landlords Association, which expressed concerns about those regulations. The letter dated 6 December from the Minister notes that the Government has addressed the concerns of landlords, agents and representative bodies in the Renting Homes (Fees etc.) (Holding Deposit) (Specified Information) (Wales) Regulations 2019.

Assembly lawyers have identified one merits point for reporting, which notes that the regulations were made in breach of the 21-day rule—the lawyer to expand upon that.

Eto, dim ond i nodi bod brys yn yr achos hwn oherwydd bod y Llywodraeth eisiau dirymu'r rheoliadau diweddar ar ôl i landlordiaid, asiantau a chyrff cynrychioladol godi pryderon ynghylch y rheoliadau diweddar. Yn benodol, fel y crybwyllwyd, roedd pryderon ynghylch y wybodaeth a oedd angen ei rhoi a'r amser prin a oedd ar gael i baratoi ar gyfer y newidiadau hyn.

Mae'r rheoliadau newydd hyn yn ymateb i'r pryderon hynny drwy egluro pa wybodaeth sydd angen ei rhoi, a bydd y newidiadau yn dod i rym ar 28 Chwefror 2020, sydd i fod yn ddigon o amser i landlordiaid ac asiantau baratoi ar gyfer y newidiadau. Felly, dim brys o ran cychwyn y newidiadau, ond mae brys i ddirymu'r hen reoliadau, a dyna pam mae'r Llywodraeth yn torri'r rheol 21 diwrnod. 

Again, just to note that there was some urgency in this case because the Government wish to revoke recent regulations after landlords, agents and representative bodies raised concerns about these recent regulations. Specifically, as has been mentioned, there were concerns around the information that needed to be provided and the shortage of time available to prepare for these changes.

These new regulations respond to those concerns by explaining what information needs to be provided, and the changes will come into force on 28 February 2020, which will provide sufficient time for landlords and agents to prepare for these changes. So, there was no urgency in terms of commencing the new provisions, but in terms of revoking the old, and that's why the 21-day rule has been breached.

Symudwn ymlaen at 'dim offerynnau gweithdrefn'. Eitem 3.4: SL(5)484, Gorchymyn Pysgota am Gregyn Moch (Cymru) (Diwygio) 2019—papur 12 o'ch blaenau, papur 13, papur 14, y memorandwm esboniadol. Nawr, mae'r Gorchymyn hwn yn diwygio Gorchymyn Pysgota am Gregyn Moch (Cymru) (Diwygio) 2019, er mwyn cyfyngu ar gwmpas y gwaharddiad presennol ar gludo cregyn moch rhy fach gan gychod pysgota'r Deyrnas Unedig ym mharth Cymru. Yn benodol, caiff cychod pysgota'r Deyrnas Unedig eu hesemptio o'r gwaharddiad cludo os nad ydynt wedi pysgota ym mharth Cymru, ond yn teithio drwyddo. 

Mae cyfreithwyr y Cynulliad wedi nodi un pwynt rhinweddau i gyflwyno adroddiad arno mewn perthynas efo'r weithdrefn a ddewiswyd ar gyfer y Gorchymyn. Cafwyd ymateb gan y Llywodraeth. Y cyfreithiwr i ymhelaethu.

Moving on to no-procedure instruments. Item 3.4: SL(5)484, the Whelk Fishing (Wales) (Amendment) Order 2019—paper 12 in front of you, paper 13 and paper 14, the explanatory memorandum. Now, this Order amends the Whelk Fishing (Wales) (Amendment) Order 2019, so as to narrow the scope of the existing ban on carriage of undersized whelk by UK fishing boats within the Welsh zone. Specifically, UK fishing boats that have not fished in the Welsh zone, but travel through it, will be exempted from the carriage ban. 

Assembly lawyers have identified one merits point for reporting in relation to the procedure selected for the Order. A Government response has been received. And the lawyer to comment. 

A'r pwynt sy'n codi yw nodi nad oes gweithdrefn ffurfiol i'r Gorchymyn hwn, felly offeryn heb weithdrefn yw hwn. Ond pan osodwyd y Gorchymyn, dywedodd y Llywodraeth fod y Gorchymyn yn dilyn y weithdrefn negyddol. Mae'r Llywodraeth wedi ymateb; maen nhw'n derbyn y pwynt, ond mae'n debyg nad ydynt yn bwriadu dirymu ac ail-wneud y Gorchymyn. Ac rydym wedi ystyried ymateb y Llywodraeth, a chredwn fod yr ymateb yn dderbyniol. Er bod yr offeryn wedi ei labelu yn offeryn negyddol mewn ffurflenni gosod ac yn y memorandwm esboniadol, nid yw hynny yn ddigon i droi'r Gorchymyn yn offeryn negyddol.

Felly, gall y Cynulliad drin y Gorchymyn hwn fel offeryn heb weithdrefn, a chyhoeddi'r Gorchymyn ar y rhan o'r wefan sydd ar gyfer offerynnau heb weithdrefn, ac, wrth gwrs, gan mai offeryn heb weithdrefn yw hwn, ni fyddai cynnig ar gyfer dirymu yn bosib. Serch hynny, efallai y byddai'n ddefnyddiol pe bai'r Llywodraeth yn newid y memorandwm esboniadol i egluro'r sefyllfa ynghylch y weithdrefn, a gellir ychwanegu'r awgrymiad hwnnw at yr adroddiad os yw'r pwyllgor yn dymuno. 

And the point arising is to note that there is no formal procedure for this Order, so it is a no-procedure instrument. But when it was laid, the Government did state that the Order followed the negative procedure. The Government have responded; they accept the point, but it appears that they do not intend to revoke and remake the Order. We have considered the Government response, and we believe that it is acceptable. Although the instrument is labelled as being negative in tabled documentation and the explanatory memorandum, that isn't sufficient to make the Order a negative instrument.

So, the Assembly can deal with this Order as an Order without procedure, and publish it on the appropriate section of the website, and, of course, as this is a no-procedure instrument, a revocation proposal wouldn't be possible. However, it may be useful if the Government were to change the explanatory memorandum just to explain the situation in terms of procedure, and that suggestion could be added to the report if the committee so chooses.

Moving on to item 4: Instruments that raise issues to be reported to the Assembly under Standing Order 21.2 or 21.3. We have considered them previously: 4.1 is SL(5)476, the Meat (Official Controls Charges) (Wales) (Amendment) Regulations 2019. In front of you, you have paper 15, and paper 16 is the Welsh Government's response. Now, of course, as background, the committee considered these regulations in our meeting on 9 December 2019, at which time Assembly lawyers noted some drafting errors within the report. The Government has since issued a response to the report, which references the same drafting errors. As noted at the meeting of 9 December, the drafting errors within the report will be corrected before the report is laid before the Assembly. More comments from Gareth, perhaps.

The drafting corrections are accepted and we apologise for those, and thanks to the Government for raising them. In terms of the Government's response to the reporting point, the Government explained that the reporting point is incorrect. The reporting point noted that one possible impact of the regulations was that abattoirs or sites that had been authorised in the past were no longer authorised. And the Government explained that this is not one of the possible impacts of these regulations, and they have responded in more detail, and that response is on pack-page 106 to 109.

Moving on to item 5: subordinate legislation that raises no reporting issues under Standing Order 21.7. Paper 17 in front of you—subordinate legislation with clear reports, negative resolution instruments. And 5.1, therefore, is SL(5)479: Code of Practice for the Welfare of Meat Chickens and Meat Breeding Chickens. This code of practice applies to all meat chickens and meat breeding chickens for which a person is responsible. The purpose of the code is to ensure that those who are responsible for an animal are aware that they have a legal duty to take reasonable steps to ensure welfare needs are met. The code of practice explains what you need to do to meet the standard of care the law requires. We considered the original code back in September. Due to several errors, it was subsequently withdrawn on 2 October 2019, and re-laid on 5 December 2019. Any comments there? No. Any comments from anyone else? No. We'll include the report as it is. Item 5.2, SL(5)480 Code of Practice for the Welfare of Laying Hens and Pullets. This code of practice covers all parts of the laying hen production sector, including pullets and breeding birds, and all types of husbandry systems. It covers single or multiple laying hens kept on a small holding, a hobby or backyard flock, as well as commercial laying hen producers. The purpose of the code is to ensure that those who are responsible for an animal are aware they have a legal duty to take reasonable steps to ensure its welfare needs are met. And it explains what those persons must do in order to meet the standard of care that the law requires. Moving on to item 6: Statutory instruments requiring Assembly consent (Statutory Instrument Consent Memorandums). Therefore, 6.1—we're talking about SICMs now—SICM(5)27 the Pilotage Act 1987 (Amendment) Regulations 2019. Papers 18, 19, 20, 21 and 22 are in front of you, as background. The Pilotage Act 1987 (Amendment) Regulations 2019 were laid before the UK Parliament on 7 October last year. The regulations update the definition of EEA state in the Pilotage Act 1987 (Amendment) Regulations 2019, so that it includes states that became a party to the European Economic Area agreement after May 2003. The Welsh Government laid a statutory consent memorandum in respect of these regulations on 18 December 2018. The letter from the Minister indicates that the Welsh Government will be tabling a motion for debate in early January. A comment from the lawyers here.

Item 7.2, a letter from the Minister for Environment, Energy and Rural Affairs to the Llywydd: the Withdrawal of The Sustainable Drainage (Enforcement) (Wales) (Amendment) Order 2019. This is a letter—paper 24—dated 11 December 2019. Again, we're invited to note, but the letter from the Minister does indicate that it is the Welsh Government's intention to withdraw the Order, which the Assembly approved in Plenary on 26 November 2019. Moving on, therefore, to item 7.4, a letter from the Deputy Minister for Culture, Sport and Tourism: the Creative Europe Programme and Europe for Citizens Programme (Revocation) (EU Exit) Regulations 2019. You'll see the letter dated 19 December. Again, I invite you to note this. You will have read the letter beforehand. So, naturally, as background, on 7 November 2019, the Chair wrote to the Deputy Minister acknowledging that there had been a breach of the inter-governmental agreement by the UK Government in relation to these regulations, but asking why it took so long for the National Assembly to be notified about that breach. And the Deputy Minister's letter provides an explanation for the timing of the notification and a list of reasons why they couldn't complete the task within the time allocated. Perhaps we'll have a discussion on that in the private session as well. Thank you.

Item 7.5, the letter from the Minister for Finance and Trefnydd: the Council Tax Reduction Schemes (Prescribed Requirements and Default Scheme) (Wales) (Amendment) Regulations 2020. You'll as see paper 31, a letter dated 20 December. Are you happy to note that letter? One of the things to note is that the letter is dated 20 December 2019, as I've stated, but it was received on 3 January 2020, and the regulations are scheduled to be debated in Plenary tomorrow, 7 January.
